1. Introduction

1.1. These Medical Tutor Terms of Service (the “Terms”) govern the legal relationship between Medical Tutor s.r.o., as the operator of the Medical Tutor service (the “Provider” or “we”), and you, as the person using the Service (“you”).

1.2. The purpose of these Terms is to describe the rules for using the Service in a clear and predictable manner. In particular, they explain what Medical Tutor offers, how the Trial and Subscription work, the fair use rules, our approach to AI Outputs, and the basic rules of liability.

1.3. By using the Service, creating an account, submitting a query in the AI chat, or purchasing a Subscription, you confirm that you have read, understood and agree to these Terms.

1.4. If you do not agree to these Terms, do not use the Service.

1.5. These Terms are drawn up in Czech. If a translation into another language is available, it is provided for your convenience only; in the event of any conflict, the Czech version shall prevail unless applicable law requires otherwise.

2. Definitions

“Service” means the Medical Tutor online educational service operated by the Provider and made available primarily through a web interface in an internet browser.

“Website” means the Provider’s websites, in particular https://medicaltutor.ai, and related subdomains or web interfaces through which the Service is made available.

“User Account” means the electronic account you create in order to use selected features of the Service.

“Trial” means time-limited free access to the full or nearly full functionality of the Service after registration, to the extent specified in these Terms or in the Service interface.

“Subscription” means paid access to the Service for a monthly or annual period, unless otherwise stated in the Service interface.

“Limited Mode” means a free mode of using the Service with limited features, which may be available after the Trial or Subscription ends.

“Content” means all texts, explanations, images, illustrations, questions, quizzes, flashcards, e-books, databases, design elements and other materials available within the Service, including outputs generated by artificial intelligence.

“AI Outputs” means responses, summaries, explanations, suggestions or other outputs generated through artificial intelligence models used in the Service.

3. What Medical Tutor Is and What It Is For

3.1. Medical Tutor is an educational platform focused on medicine and related healthcare fields. The main purpose of the Service is to help you study, review, understand and practice educational material.

3.2. The Service may include in particular:

  • AI chat for explaining medical concepts, relationships and structures,
  • e-books and other study texts,
  • quizzes, review questions and other practice tools,
  • flashcards and other memorization tools,
  • visual study materials, if included in the current version of the Service,
  • other features that we may add, modify or remove over time.

3.3. The Service is intended solely for study and educational purposes. It is not intended as a tool for diagnosis, treatment, clinical decision-making, emergency medical assistance, or as a substitute for professional consultation.

3.4. The Service is generally available online through a web browser. If we offer additional access methods or integrations in the future, they will be governed by these Terms and, where applicable, supplementary rules.

4. Formation of the Agreement and Basic Rules of Use

4.1. The contractual relationship between you and the Provider arises when you first use the Service, register a User Account, or order a Subscription, whichever occurs first.

4.2. The Terms are available in a form that allows them to be saved and viewed repeatedly. We recommend that you save them for future reference.

4.3. If these Terms conflict with information provided directly during the ordering process or in a specific plan, the information in the ordering process or relevant plan shall prevail with respect to price, billing period and the scope of that plan.

4.4. We reserve the right to refuse or restrict access to the Service if its use would violate applicable law, these Terms, or the legitimate interests of the Provider or other users.

5. Age and Eligibility

5.1. The Service is intended for persons over 16 years of age.

5.2. If you are under 16, you may use the Service only with the consent of your legal guardian. We may request reasonable evidence of such consent at any time and may restrict or suspend access to the Service until it is provided.

5.3. By using the Service, you represent that you meet the age and eligibility requirements set out in this section.

6. User Account and Security

6.1. To activate the Trial and use a Subscription, you will generally need to create a User Account.

6.2. When registering, you must provide truthful, accurate and up-to-date information and update it without undue delay if it changes.

6.3. You may not create accounts on behalf of another person without authorization, use false identities, or provide misleading information.

6.4. You are responsible for the security of your login credentials. Do not share your password or other access to the Service with other persons.

6.5. You are responsible for all activity carried out through your User Account unless you demonstrate that you were not responsible for the misuse of the account.

6.6. If you suspect unauthorized access, account misuse or a security incident, contact us immediately at tutor@memorix.cz.

6.7. We may temporarily suspend, restrict or terminate an account, in particular if you breach these Terms, misuse the Service, threaten its security, or where necessary for legal or operational reasons.

7. Technical Requirements and Availability

7.1. To use the Service, you need, in particular, a working internet connection, a compatible device and a currently supported web browser.

7.2. You are responsible for the costs of your device, internet connection and ordinary security measures for your device.

7.3. We strive to provide the best possible availability and stability of the Service, but we do not guarantee uninterrupted or error-free operation.

7.4. The Service may be temporarily unavailable, in particular due to scheduled maintenance, updates, technical problems, force majeure, outages of third-party services, or other circumstances beyond our reasonable control.

7.5. We are not liable for inability to use the Service resulting from problems on your side, with your internet provider, or with other third parties that we cannot reasonably control.

8. Trial, Subscription and Payments

8.1. After registration, you receive the free Registered mode. If you meet the current eligibility requirements for the Trial, you may activate Trial mode. The duration of the Trial and the conditions for activation are stated in the Service interface. Unless stated otherwise at activation, no payment details are required to use the Trial and no paid Subscription will automatically begin when it ends.

8.2. During the Trial, you have access to features and limits corresponding or similar to Premium mode. The current scope of features and any technical limits are stated in the Service interface. The Trial is subject to the fair use and anti-abuse rules under Section 10.

  • unlimited AI chat queries,
  • unlimited use of the e-book,
  • unlimited quizzes,
  • unlimited flashcards.

8.3. We reserve the right to modify the scope of features available during the Trial where reasonably justified by operations, product development or protection against abuse. Such a change will not affect an already concluded paid Subscription.

8.4. After the Trial ends, you may continue using the Service through a paid Subscription. A Subscription may be offered monthly or annually, or in other variants if stated in the Service interface.

8.5. Before you complete an order, we will always display the price, billing period and basic scope of the relevant plan. Any applicable tax or other statutory charges will be displayed during the ordering process or in accordance with the payment provider’s rules.

8.6. The Subscription automatically renews for another identical period unless you cancel it before the end of the then-current period.

8.7. Payments are processed securely through Stripe or another payment provider that we may use in the future. The relevant payment service provider’s terms may also apply to payment processing.

8.8. By purchasing a Subscription, you agree that the applicable payments will be charged on a recurring basis in accordance with your chosen plan until you cancel the Subscription in time.

8.9. You may cancel your Subscription at any time. Cancellation means that the next period will not renew; however, your access to the full features of the Service will remain available until the end of the period already paid for.

8.10. Amounts paid are non-refundable, except where required by mandatory law or where we expressly decide otherwise.

8.11. We may change prices, plan names or plan structures in the future. Such changes will generally apply only to subsequent billing periods, and we will provide reasonable advance notice.

8.12. We may offer discount codes, promotional offers, special campaigns or preferential terms for certain groups of users. Separate rules may apply to such offers.

9. Limited Mode without a Subscription

9.1. If you do not activate a Subscription after the Trial ends, or if your Subscription ends, you may continue to use the Service in Limited Mode if we offer it at that time.

9.2. The Provider determines the scope of features available in Limited Mode based on the current version of the product. This may include, for example, a limited number of queries, limited access to Content, or only selected study tools.

9.3. You are not entitled to have the scope of features in Limited Mode remain permanently unchanged. We may modify, expand, restrict or discontinue it at any time.

10. Fair Use Policy and Prohibited Use

10.1. The Service is intended for your personal educational use unless we expressly agree otherwise.

10.2. Even where a part of the Service is described as “unlimited”, this means use within the limits of ordinary and fair use. We reserve the right to intervene where use is unreasonable, automated, or threatens the stability and availability of the Service for others.

10.3. In particular, the following constitute violations of the fair use rules:

  • automated or bulk submission of queries using scripts, bots, crawlers or other tools without our express consent,
  • attempts to circumvent limits, technical restrictions, authentication mechanisms or other protective elements of the Service,
  • sharing an account with other persons or allowing multiple users to access the Service through one account without our authorization,
  • scraping, bulk downloading, exporting or systematic copying of Content,
  • using the Service or its outputs to train your own AI models, create a competing product, or for other commercial use without our prior written consent,
  • reverse engineering or attempts to discover the internal logic of models, technical solutions or Service infrastructure beyond what is permitted by law,
  • using the Service in a manner that may harm the Provider, other users or third parties,
  • using the Service to engage in cheating in tests, examinations or other forms of assessment where this conflicts with the rules of a school, university, employer or other institution,
  • submitting unlawful, harmful, harassing or otherwise inappropriate content to the Service.

10.4. If you breach this section, we may, depending on the seriousness of the situation, restrict features, temporarily suspend access, terminate the account, refuse a further order, or take other reasonable technical and legal measures.

10.5. This section does not affect any other rights available to us under applicable law or any claim for damages where we suffer loss.

11. Artificial Intelligence, Professional Limitations and Medical Disclaimer

11.1. The Service uses artificial intelligence models and other automated tools to create explanations, answers, summaries and other study outputs.

11.2. When creating Content and configuring the Service, we draw on professional educational sources, including Memorix professional materials and other medical educational resources that we select and update over time. Nevertheless, we cannot guarantee that every AI Output will always be accurate, complete, error-free or up to date.

11.3. AI Outputs may contain inaccuracies, simplifications, omissions or outdated information. You should therefore treat them as a study aid, not as the sole or definitive source of truth.

11.4. Neither the Service nor its outputs constitute medical advice, a healthcare service, a diagnosis, a treatment plan, or a professional clinical decision. The Service does not replace a physician, teacher, supervisor or other qualified professional.

11.5. If you are dealing with health concerns, diagnosis, treatment, dosage, an acute condition, or other practical healthcare matters, always consult a qualified healthcare professional.

11.6. You must use your own judgment and verify important information using other reliable sources. In particular, if you are a healthcare student or healthcare professional, you must not use Service outputs as the sole basis for clinical or other highly sensitive decisions.

11.7. You are responsible for decisions you make based on Service outputs. The Provider is not liable for damage or other harm resulting from reliance on an AI Output without further verification or from using it for purposes other than education.

12. Intellectual Property and License to Use the Service

12.1. All Service Content, in particular texts, e-books, questions, quizzes, flashcards, graphics, databases, software, source code, trademarks, know-how and other components of the Service, is protected by intellectual property laws and belongs to the Provider or its licensing partners.

12.2. For the duration of your authorized use of the Service, we grant you a limited, non-exclusive, non-transferable and revocable license to use the Service and its Content for your personal, non-commercial study purposes to the extent necessary for ordinary use of the Service.

12.3. Without our prior written consent, you may not, in particular:

  • copy, distribute, publish, sell, license or otherwise commercially exploit the Content,
  • create derivative works, databases or compilations based on systematic extraction of Content,
  • bulk-download or export data, questions, quizzes, texts or AI Outputs,
  • remove notices of rights, authorship, trademarks or technical protection measures,
  • use the Service, Content or AI Outputs to train your own AI models or develop a competing service.

12.4. AI Outputs provided through the Service are intended for your personal study needs. The fact that AI generates specific text for you does not mean that you acquire the right to exploit that text commercially in a way that circumvents this section or harms our legitimate interests.

12.5. If you send us an idea, feedback or a suggestion for improving the Service, we may use it free of charge unless we expressly agree otherwise.

13.1. The Service may contain links to third-party websites, tools or services, such as payment providers, analytics tools or supplementary study resources.

13.2. We are not responsible for the content, functionality, availability or security of third-party services. Use of such services is governed by the terms of the relevant third party.

13.3. If you make a payment through Stripe or another payment service, that provider’s terms and privacy policy may also apply to the payment.

14. Privacy and Communications

14.1. The processing of your personal data is governed by the separate Privacy Policy available on the Website.

14.2. In connection with operating the Service, we may send you operational, transactional and security messages, including registration confirmations and information about payments, Subscription changes, security incidents or changes to the Terms.

14.3. We will send marketing communications and newsletters only in accordance with applicable law and to the extent permitted by your consent or another lawful basis.

14.4. You are responsible for maintaining a functioning and up-to-date e-mail address in your account where the account is based on e-mail. A notice sent to that address is deemed delivered when sent unless applicable law requires otherwise.

15. Liability and Limitation of Liability

15.1. To the extent permitted by law, the Service is provided “as is” and “as available”. This means that we do not guarantee that it will always be error-free, continuously available, completely accurate, or suitable for all of your particular purposes.

15.2. In particular, we are not liable for:

  • temporary unavailability of the Service, outages, technical errors or compatibility limitations,
  • inaccuracies, incompleteness or outdated Content or AI Outputs,
  • damage resulting from using Service outputs without further verification or for purposes other than education,
  • damage caused by third parties, such as an internet connection outage, hosting provider, payment processor or other external system,
  • loss of profit, loss of data, business interruption or other indirect or consequential damages, where permitted by law.

15.3. To the maximum extent permitted by law, our total liability to you is limited to the amount of fees you actually paid us for the Service during the 12 months preceding the event giving rise to the claim.

15.4. The limitations of liability in this section do not apply to the extent that liability cannot be excluded or limited under mandatory law, in particular in cases of intentionally caused harm or other cases expressly protected by law.

15.5. If you are a consumer, nothing in these Terms limits any rights granted to you by mandatory consumer protection law.

16. Termination of the Account and Contractual Relationship

16.1. You may stop using the Service at any time. If you have an active Subscription, cancelling it stops further renewals, but you will retain access to paid features until the end of the paid period.

16.2. You may request deletion of your account through the available account settings or by e-mailing tutor@memorix.cz.

16.3. We may temporarily restrict or terminate your account or access to the Service, in particular if:

  • you breach these Terms,
  • you misuse or attempt to misuse the Service,
  • you threaten the security, availability or reputation of the Service,
  • this is necessary due to legal obligations, protection of third parties or a security incident.

16.4. Where reasonable in view of the nature of the breach, we may give you an opportunity to remedy it before terminating your account. In the event of a serious or repeated breach, we may restrict or terminate access without prior notice.

16.5. Termination of the account or contractual relationship does not affect provisions of the Terms that by their nature are intended to survive termination, in particular provisions on intellectual property, liability, dispute resolution and protection of the Provider’s rights.

17. Changes to the Service and Terms

17.1. We continuously develop the Service. We may therefore modify, supplement, improve, restrict or discontinue individual Service features.

17.2. We may likewise reasonably update these Terms, in particular where there is a change in applicable law, the business model, technical solution, AI tools used or security requirements.

17.3. We will inform you of material changes in an appropriate manner, for example by a notice in the application or by e-mail and, where reasonably possible, with reasonable advance notice.

17.4. A new version of the Terms becomes effective on the date specified in it. If you continue to use the Service after that date, you will be deemed to have accepted the change.

17.5. If you do not agree with a change to the Terms, you may stop using the Service and, where applicable, cancel your Subscription. This does not affect payment obligations already due for periods that have elapsed or are ongoing.

18. Governing Law and Dispute Resolution

18.1. These Terms and the legal relationship between you and the Provider are governed by the laws of the Czech Republic.

18.2. Any disputes arising in connection with use of the Service or these Terms shall be resolved by the competent courts of the Czech Republic unless mandatory law provides otherwise.

18.3. If you are a consumer, this provision does not affect any rights you have under mandatory consumer protection laws in your home country.

18.4. If you are a consumer and a dispute arises between us, you may also contact the competent alternative consumer dispute resolution body under applicable law; in the Czech Republic, the Czech Trade Inspection Authority is generally competent for disputes outside areas assigned by law to another body.

19.2. When contacting us, please provide sufficient information for us to identify you and resolve your request promptly.

20. Final Provisions

20.1. If any provision of these Terms is found to be invalid, ineffective or unenforceable, this does not affect the validity and effectiveness of the remaining provisions. The affected provision will be replaced by a provision that most closely reflects its meaning and purpose.

20.2. These Terms take effect on 20 September 2026 and replace previous versions of the Medical Tutor Terms of Service to the extent that they apply to use of the Service from that date.

The Czech version is binding. Other languages are informative translations.
